We Take Privacy Seriously

The protection of your privacy when processing personal data is important to us. Whenever you visit the Design Hotels online job board (hereinafter “Job Board”), our web servers or those of our Data Processor “umantis” will store the IP address of your Internet service provider, the website from which you access our Job Board, the sub-sites you visit in the Job Board, as well as the date and duration of your page visit. This information is required for technical website transfer and secure server operation. No personalized evaluation of data takes place.

Any data sent to us via the contact form will be stored during the backup process either on our or the servers of our Data Processor. Your data will only be used for the specific purpose of processing your request. It will be treated as strictly confidential. No data will be passed on to external third parties.

Personal data is data that identifies you as a person including, for example, your name, address and email address. No personal data must be provided to visit our website. Certain services, however, will require your name, address and some further information.

Data Automatically Processed During the Website Visit
When you visit our Job Board, we or umantis, will store information for administrative and technical purposes. This data includes the type and version of the browser used, date and time of access, as well as your IP address. It will be anonymized and only used for statistical purposes, or for enhancing our online services and securing their functionality. This anonymized data is stored in secure systems separately from any personal data. It cannot be allocated to an individual person, which keeps your personal data protected at all times.

When you visit our Job Portal, information may be stored on your computer in the form of Cookies. Cookies are small files that are transferred from an Internet server to your browser and stored on the hard disk. During this process, the Internet Protocol address, but no personal data is saved. The information stored in the Cookies helps us to enhance usability, as it allows us to automatically recognize you when you revisit our Job Portal. Information for Job Applicants when Using our Job Portal (Art. 13 GDPR)


Purpose
Any personal data provided will only be collected and processed in the context of your job application, for the purpose of recruiting or, in case of a successful application, the initiation, execution or termination of an employment.

Pursuant to Art. 13 para. 2 lit. e) GDPR, we are obliged to inform you that you are not required to provide any personal data. Please note, however, that we will not be in the position to commence the recruiting process without certain personal data.

Any processing of special categories of personal data is done so pursuant to Art. 9 para. 1 GDPR within the framework of the recruiting process, in order to execute our rights or fulfill our legal obligations arising from labor law, the law of social security, and the Code of Social Law (e.g. informing the representative Council of Employees with Disabilities, Code of Social Law IX, section 81). This is based on Art. 9 para. 2 b) GDPR in conjunction with Section 26 para. 3 Federal Data Protection Act.

Data
We mainly require your master data (first and last name, name affixes, nationality), your contact data (home address, mobile number and landline number, email address), your resume including all content, references including all content, cover letters including all content, and any other information, which is relevant for your application such as information on your skills, work samples, special health information, and – if applicable – your criminal record, as well as protocol data generated during the use of the IT systems.

Data Sources
Your personal data will mainly be collected and encrypted, or it will be pulled from publicly available sources (e.g. professional online networks such as Xing, LinkedIn, GitHug).

Authorization for Access
At Design Hotels, only those persons, who need your personal data for the fulfillment of our contractual or legal obligations, such as the HR department, the accounting department, and the respective department heads, are authorized to access your personal data. During the recruiting process, only persons actively participating in the process will get access to your personal data. Access is always limited to the necessary scope. To fulfill our contractual or legal obligations, we engage third-party IT specialists such as umantis who process applicant data on our behalf and based on our instructions.

Transfer of Data to External Third Parties
In case of a successful application and signing of an employment agreement with Design Hotels, personal data might also be transferred to third parties outside our organization, however, only if required for the fulfillment of our contractual and legal obligations. Our Job Board is operated by Haufe-Lexware GmbH & Co. KG, Fraunhoferstrasse 5, 82152 Planegg, („umantis“).

Transfer of Data to a Third Country
No personal data will be transferred to a third country.

Legal Basis
Your personal data will be processed subject to the valid laws and regulations, including the GDPR, the Federal Data Protection Act, the Works Constitution Act, the Working Hours Act, etc.

Any data processing is mainly done to prepare, initiate, execute or terminate an employment - see Art. 6 para. 1 b) GDPR in conjunction with Section 26 para. 1 Federal Data Protection Act. Further, collective agreements (group agreements, works agreements and contractual provisions) pursuant to Art. 6 para. 1 b) in conjunction with Art. 88 para. 1 GDPR, in conjunction with Section 26 para. 4 GDPR, as well as any separate consents pursuant to Art. 6 para. 1 a) 7 GDPR in conjunction with Section 26 para. 2 Federal Data Protection Act (e.g. in case of video recordings) may be considered as data privacy permission regulations. If your permission is required for the processing your personal data, you have the right to revoke this permission at any time with effect for the future.

To fulfill our legitimate interest or that of a third party (e.g. government authorities), we will process your personal data also based on Art. 6 para. 1 f) GDPR. This, in particular, applies to the investigation of a crime (legal ground: Section 26 para. 1 page. 2 Federal Data Protection Act) or may be done for corporate control purposes, internal communication or other administrative reasons.

You will be informed if we want to process your personal data for any purpose other than those mentioned here.

The following applies regarding the storage time for any data:

Recruiting Process
Any personal data related to the application for a specific job will be stored and processed for the duration of the recruiting process. At the end of the recruiting process (e.g. upon a job offer or decline), your data will be deleted from our system latest 6 months after the end of the recruiting process. In case of a job offer, we reserve the right to store your application longer, if your job start date is more than 5 months away.
If we like your profile, but currently have no suitable vacancy, we would like to add your resume to our talent pool to be able to keep in touch and consider you for future opportunities. In this case, we will obtain your written consent to store your personal data for this specific purpose.

Upon signing of an employment agreement
All data collected during the recruiting process will be transferred to your personnel file. We will delete this data and other data collected during your employment with us, as soon as it is no longer required for the above-mentioned purposes. You will receive further information on data privacy as part of your employment.

You have a right to information vis-à-vis your employer about all personal data processes during the employment relationship. Under certain circumstances, you may request correction or deletion of your personal data. Further, you may have the right to limit the processing of your personal data as well as a right to transfer your personal data in a structured, usual and machine-readable format.


Right of Objection
At any time and without stating any grounds, you have the right to revoke your consent to the processing of your personal data for recruiting purposes, if we use any personal data upon your consent for the purpose of processing your application. If the purpose for processing is not the signing of an employment agreement, but the data is processed based on legitimate interest, you may revoke this processing for reasons related to your specific situation. We will then discontinue processing your personal data unless we can prove compelling legitimate grounds, which override your interests, rights, and freedom, or the processing serves the enforcing, execution or defense of legal claims.

If our Data Protection Officer fails to answer your requests to your satisfaction, you may file a complaint with the data protection authorities. The competent authority is:
